Terms of Sales

Article 1- Scope of application

The general terms and conditions of sale (“GTCS”) apply to all orders placed via theeShop of Alpagrumi Sagl, at the following URLs www.alpagrumi.ch and www.alpagrumi.com (“eShop“).

Alpagrumi Sagl reserves the right to modify the T&Cs without prior notice. The version of the GTC applicable is the one valid at the date of the order confirmation by the customer.

Article 2 – Offer

The offer is addressed to any person (natural or legal) regardless of his domicile or headquarters. The products may only be exported in compliance with Swiss export regulations and under the exclusive responsibility of the exporting customer.

The offer is valid as displayed in the eShop while stocks last. Changes to prices and quantities available are possible at any time. The images presented in the eShop or on any other sales document, as well as all information on the products are purely indicative and have no contractual value.

Price

All prices in the eShop are in Swiss francs, including value added tax (VAT).

The price that is binding is the one presented in the eShop at the time of the order confirmation by the customer.

Any additional services or materials must be paid for in cash when the products are collected.

Ordering

The display of plants (or other products) in the eShop is not legally binding. The eShop is a purely indicative online catalog that allows customers to order and pay for plants (or other products). Alpagrumi Sagl reserves the right to restrict the quantities of plants (or other products) that can be ordered through the eShop.

After confirmation of the order in the eShop, the customer automatically receives an order form, which confirms that the order has been received by Alpagrumi Sagl. The order is not cancelable or modifiable after the reception by Alpagrumi Sagl.

Conclusion of the contract

The contract is concluded as soon as the payment is received on the bank account of Alpagrumi Sagl.

After this payment the customer can reserve a date for the collection of the plants (or other products) through the websites www.alpagrumi.ch or www.alpagrumi.com. The plants (or other products) can be collected from the store of Alpagrumi Sagl, via El Temeris 3, 6513 Monte Carasso (Bellinzona).

As soon as a date for the pick-up of the plants (or other products) has been booked, the customer receives a confirmation by email.

Alpagrumi can, without having to justify the reason, refuse all or part of the order. In this case, the customer is informed and the payments already received by Alpagrumi Sagl are refunded. Any further claims on the part of the customer are excluded. Products that are out of stock or indicated as not available in the eShop cannot be ordered.

Orders may be cancelled by the customer within 7 days of purchase. Cancellation requests must be made in writing, e.g. by e-mail. The refund will be made by AlpAgrumi Sagl within 10 days of the cancellation request. The fees and commissions associated with payment by bank card or Twint will be deducted from the amount refunded to the customer, rounded up to the nearest franc. A fixed cancellation charge of 15 Chf will also be levied by AlpAgrumi Sagl as compensation for the costs generated by the cancellation.


Section 3 –

Collection

of plants from Alpagrumi Sagl

Store in Monte Carasso (Bellinzona)

The exclusive place of collection is the store of Alpagrumi Sagl in Monte Carasso (Bellinzona), via El Temeris 3. The place of collection may be modified by Alpagrumi in the future and will be mentioned in an updated version of the GTC.

Alpagrumi makes deliveries directly and by its own means of transport. The post office does not accept citrus trees, as the size and fragility of the plants make this impossible. Home deliveries are grouped together around once a month and are made throughout Switzerland, with the exception of Ticino and part of Graubünden. For these areas, individual deliveries are possible at the customer’s specific request.

General

The amount of the order must have been previously paid by the customer before the collection of plants (or other products) in the store of Alpagrumi Sagl.

For the collection of the order the customer or his representative must present the order confirmation received by email. He confirms the withdrawal of the plants by a signature on this confirmation of order of which the original remains to Alpagrumi Sagl. Any damage to the plants (or other products) during the collection process (breakage, loss, theft, etc.) is the sole responsibility of the customer or his representative who made the collection.

The ordered products must be picked up by the customer by appointment. Appointments are made through www.alpagrumi.ch or www.alpagrumi.com. The customer receives an appointment confirmation by email. Failure to book an appointment is the sole responsibility of the client. If a customer shows up without an appointment Alpagrumi Sagl has no obligation to allow the removal of the plants.

If the customer is unable to collect all or part of the plants ordered, due to lack of space or the unavailability of a suitable vehicle, Alpagrumi Sagl will not be held responsible. The customer is required to book a new appointment and to come to the store able to collect the order. Alpagrumi Sagl is under no obligation to refund the order, nor to provide plants of equivalent value in this event.

The plants are supplied in special shaped pots (Air-Pottm) to ensure the health and integrity of the root system.

The Air-Pots are removable and reusable. Customers are strongly encouraged not to throw them away. They can be returned to Alpagrumi Sagl at the Monte Carasso store.

Transport costs and conditions

Transport costs are defined by Alpagrumi and published on the www.alpagrumi.ch website on the dedicated page.

Transport dates (approx. monthly) are published on the same page.


Fees for

levy

There is no charge for picking up plants at the Alpagrumi Sagl store.

Article 4 – Warranty

Alpagrumi Sagl guarantees the quality of the plants under the following conditions:

  • Plants are delivered in pots.

  • Plants are delivered live in a vegetative state appropriate to the season.

Alpagrumi Sagl does not offer any guarantee of refund or exchange. The customer is responsible for any return shipping costs.

There is no general right of return on plants removed from the store by the customer. The warranty is explicitly excluded for products ordered through the eShop and paid for by mistake or inattention.

Article 5 – Complaints

If the plants offered at the time of withdrawal are dead or show significant visible damage, in consideration of the season and the corresponding vegetative state, the customer may refuse the withdrawal. Damaged plants will be replaced by equivalent plants or refunded immediately if out of stock.

If the plants ordered and paid for are not available at the time of the pick-up appointment in the store, the customer will be offered either to wait for the restocking (with a new appointment), or plants available in the store for an equivalent amount, or immediate reimbursement of the order amount.

It is the customer’s responsibility to properly transport and store the plants after pickup at the store.

Article 6 – Payment options

All payments must be made in Swiss francs in advance, before the plants are picked up at the store.

Electronic payment methods

The accepted means of payment are credit cards (Visa, Mastercard, Postfinance). In case of payment by credit card, the debit will be made at the time of the order.

Purchase by bank transfer

The order is put in preparation as soon as the payment is received.

For the purchase by bank transfer, the customer must have his residence or his seat in Switzerland.

Refunds, credit notes, credit

If the customer is entitled to refunds, they will be paid in cash at the store. The customer is required to sign a receipt for the refund.

Orders that have already been paid for cannot be changed or cancelled.

Article 7 – Applicable law and jurisdiction

The legal relationship between Alpagrumi Sagl and the client is governed by Swiss law.

The place of jurisdiction is Bellinzona (Canton Ticino).
